EaseMind Terms of Use

1. Acceptance of Terms

Welcome to EaseMind. By accessing or using our mobile app, website, and related services (collectively, "Service"), you agree to comply with these Terms of Use ("Terms"). If you do not agree with any item, do not use the Service.

These Terms constitute a legal agreement between you ("User") and EaseMind, Inc. ("EaseMind", "we", "our").

2. Service Description

EaseMind is an emotional support and mental wellness app that offers:

• Conversations with Luna, an empathetic AI virtual assistant
• Guided breathing, meditation, and relaxation sessions with music
• Emotional journal for recording feelings and progress
• SOS button for emotional crises with guidance and calming music
• Educational content about mental health and self-care

2.1. What EaseMind Is NOT

IMPORTANT: EaseMind is NOT:

• A regulated mental health service
• A substitute for professional therapy, psychology, or psychiatry
• A medical diagnosis or treatment tool
• An emergency service for suicidal crises (call 988 - Suicide & Crisis Lifeline or 911)

EaseMind does not diagnose, does not prescribe medication, and should not be used as the sole intervention for serious mental disorders. If you are in crisis or considering self-harm, seek professional help immediately.

3. Eligibility

• You must be 18 years or older to use the Service
• Users aged 13-17 need express parental/guardian consent
• Minors under 13 cannot use the Service

4. Account Creation

4.1. Registration

• You must provide true, accurate, and complete information
• You are responsible for maintaining password confidentiality
• Notify us immediately of any unauthorized account use

4.2. Prohibitions

• One person = one account (no multiple accounts)
• Do not share credentials with third parties
• Do not use false identity or impersonate others

5. Acceptable Use

5.1. You May:

• Use the Service for personal, non-commercial emotional support
• Talk to Luna about anxiety, stress, and wellness
• Record your journal and track progress
• Cancel your subscription at any time

5.2. You May NOT:

• Use the Service for illegal, fraudulent, or harmful purposes
• Attempt to access other users' data or restricted system areas
• Reverse engineer, decompile, or extract app source code
• Use bots, scrapers, or automation to interact with the Service
• Send spam, malware, or offensive content (racist, violent, sexually explicit)
• Use the Service to train competing AI models

Violations may result in account suspension or permanent deletion.

6. User Content

6.1. Ownership

You retain all rights to content you create in the app (conversations, journal, preferences). By using the Service, you grant us a limited, non-exclusive, revocable license to:

• Process your messages via AI to generate responses
• Store data for cross-device synchronization
• Use aggregated, anonymized data for service improvements

6.2. Content Removal

We may remove content that violates these Terms, our Privacy Policy, or applicable laws, without prior notice.

7. Subscriptions and Payments

7.1. Available Plans

• Free: 2 guided sessions/week, basic chat, limited journal
• Premium Monthly: $7.99/month - Unlimited sessions, Luna's voice, full journal
• Premium Yearly: $79.90/year - Same benefits with 16% discount

7.2. Payments

• Payments processed via App Store (Apple) or Google Play (Google)
• Auto-renewing subscriptions (cancel anytime)
• Prices in USD for international users
• Local taxes may apply

7.3. Cancellation and Refunds

• Cancel anytime in App Store/Google Play settings
• No refunds for already paid periods (e.g., canceling on day 15 does not generate prorated refund)
• Exceptional refunds at Apple/Google's discretion per their policies

7.4. Price Changes

We may change prices with 30 days advance notice. New prices apply only to future renewals.

8. Intellectual Property

8.1. Our Property

All rights, titles, and interests in the Service (code, design, "EaseMind" brand, content, Luna AI) belong to EaseMind, Inc. or our licensors. You do not acquire ownership rights by using the Service.

8.2. Use License

We grant you a personal, limited, non-transferable, revocable license to use the app per these Terms.

8.3. Trademarks

"EaseMind", "Luna", and associated logos are trademarks of EaseMind, Inc. Unauthorized use is prohibited.

9. AI and Third-Party Technology

9.1. AI Processing

• We use OpenAI GPT-4o-mini to generate Luna's empathetic responses
• Your messages are sent to the AI provider via secure API
• OpenAI processes data according to its Privacy Policy (https://openai.com/privacy)

9.2. AI Limitations

• Luna is an AI and does not replace human professional judgment
• Responses are based on language patterns, not clinical experience
• AI may occasionally generate inaccurate or inappropriate responses (report via app)

9.3. Audio and Music

• Guided sessions include licensed ambient music
• You may not extract, distribute, or reuse these tracks outside the app

10. Disclaimer

READ CAREFULLY:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Uninterrupted or error-free availability
• Accuracy, completeness, or reliability of content
• Specific mental health improvement results
• Absolute security against data breaches

EASEMIND IS NOT RESPONSIBLE FOR:

• Decisions made based on Luna AI's advice
• Direct, indirect, incidental, or consequential damages from Service use
• Technical failures, service interruptions, or data loss
• Third-party actions (AI providers, app stores, governments)

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASEMIND'S TOTAL LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM THESE TERMS OR SERVICE USE IS LIMITED TO THE AMOUNT YOU PAID IN THE LAST 12 MONTHS (OR $100, WHICHEVER IS GREATER).

This limitation does not apply to:

• Damages caused by our willful misconduct or gross negligence
• Rights that cannot be limited by law

12. Indemnification

You agree to indemnify and hold EaseMind, its directors, employees, and partners harmless from any claims, damages, or expenses (including legal fees) arising from:

• Violation of these Terms
• Improper use of the Service
• Violation of third-party rights

13. Termination

13.1. By You

You may close your account anytime by deleting it in app settings.

13.2. By Us

We may suspend or terminate your account immediately if:

• You violate these Terms or Privacy Policy
• Your use endangers Service security or integrity
• Required by law or court order

13.3. Effects of Termination

After termination:

• You lose access to the Service and all stored content
• Personal data is deleted per Privacy Policy
• Pending financial obligations remain (subscriptions are not refunded)

14. Modifications to Terms

We may update these Terms periodically. Significant changes will be notified via:

• Email (for material changes)
• In-app notification
• Notice on easemind.io website

Continued use after changes = acceptance of new Terms.

15. Governing Law and Jurisdiction

15.1. United States

These Terms are governed by the laws of [STATE]. Disputes will be resolved in the courts of [CITY/STATE], with waiver of any other forum.

15.2. Arbitration (Optional)

For disputes up to $50,000, we may opt for arbitration via [ARBITRATION CHAMBER], with costs split equally.

16. General Provisions

You cannot transfer your rights under these Terms. We may assign to third parties (e.g., in merger/acquisition).
